## 1. DEFINITIONS

"G-TEK," "we," "us," "our" = G-TEK IT Limited, trading as G-TEK Computers & Electronics, Ecclesfield, Sheffield, S35 9YY

"Buyer," "you," "customer" = The person purchasing goods from G-TEK

"Goods" = Computer hardware, components, peripherals, and accessories you purchase from us (graphics cards, RAM, motherboards, SSDs, hard drives, power supplies, monitors, keyboards, mice, etc.)

"Order" = Your request to purchase Goods from G-TEK

"Delivery Date" = The date we agree to deliver Goods to you (typically 2–5 working days for UK mainland, subject to availability)

"Price" = The selling price shown on our website or in your quote (excluding VAT and delivery)

## 2. APPLICABILITY OF THESE TERMS

2.1 These Terms & Conditions apply to all purchases of Goods from G-TEK. By placing an order or accepting delivery, you agree to be bound by these terms.

2.2 Any terms on your purchase order, email, or other documents are not accepted unless we confirm them in writing.

2.3 We may amend these terms at any time. Changes take effect on the date we publish them. If you don't agree with changes, you may cancel your order before it ships.

## 3. PRICE AND PAYMENT

3.1 Price: All prices are shown exclusive of VAT. VAT will be added at the rate ruling on the invoice date.

3.2 Price changes: We reserve the right to adjust prices for special orders or quotes. Prices on our website are valid for 30 days from quote date unless stated otherwise.

3.3 Payment terms: Payment is due on or before delivery unless otherwise agreed. We accept:
- Debit cards
- Credit cards (personal and commercial)
- Bank transfer
- PayPal
- Other payment methods shown at checkout

3.4 No surcharges or set-off: Payment must be made in full without deduction, set-off, or counterclaim.

3.5 Late payment: If payment is overdue, we may charge interest at 4% above Bank of England base rate per annum, accruing daily until payment is received.

## 4. DELIVERY AND RISK

4.1 Delivery: We deliver to UK mainland addresses only. Delivery times are estimates; we are not liable for delays caused by our courier or circumstances outside our control.

4.2 Risk and title: Goods are at your risk once delivered to you. You own the Goods immediately upon payment in full.

4.3 Damage in transit: If Goods arrive damaged, notify the courier within 3 working days and contact us with photographic evidence. We will arrange replacement or credit at our discretion.

## 5. INSPECTION AND ACCEPTANCE

5.1 Inspection period: You have 14 days from delivery to inspect Goods and report any faults or discrepancies.

5.2 What counts as acceptance: If you do not report a fault within 14 days, Goods are deemed accepted.

5.3 Partial inspection: If Goods are ordered in bulk, you are not required to test every single item immediately; we will accept fault claims within 14 days of any item in the batch being tested.

## 6. RETURNS AND WARRANTY

6.1 Faulty Goods (Warranty):

- All Goods come with a 12-month warranty from the date of purchase, covering manufacturing defects.
- This warranty covers failures due to normal use and workmanship, but not:
- Damage from physical impact, liquid, or overclocking
- Damage from improper handling or static discharge (you must use anti-static precautions)
- Damage resulting from software or user error
- Wear and tear on consumables (e.g., fans, power supplies after extended use)
- Goods that have been disassembled, modified, or repaired by anyone other than G-TEK or the manufacturer

- If a Goods is faulty, we will, at our discretion:
- Repair it (we may take 2–4 weeks, including time to return to the manufacturer if needed)
- Replace it with an equivalent or better specification
- Issue a credit to your account for the invoiced price

6.2 Unwanted returns (non-faulty):

- You may return unused, unopened Goods in original packaging within 30 days of purchase for a refund or credit.
- We charge a restocking fee of 10% of the invoiced price (minimum £10) to cover handling and inspection.
- Return shipping is at your cost.
- We will not accept returns of Goods that are:
- Opened, used, or tested
- Missing original packaging, manuals, or accessories
- Damaged or defaced
- Special orders or made-to-order items (non-returnable)

6.3 RMA process:

- To return any Goods, request an RMA (Returns Materialisation Authorisation) number by emailing [email protected] or contacting us via our website.
- Include your order number, the item description, and the reason for return.
- We will issue an RMA number valid for 30 days.
- Return address and shipping:
- For faulty warranty claims: return shipping is covered by us. Send to: G-TEK Computers & Electronics, [INSERT YOUR RETURN ADDRESS]
- For non-faulty returns: you pay return shipping. We will email you a return address.
- Display the RMA number clearly on the outside of the package.
- We are not liable for loss or damage during return transit.

6.4 Processing returns:

- Once we receive your returned Goods, we will inspect them within 5–10 working days.
- If found faulty or in returnable condition, we will issue a refund, credit, or replacement within 10 working days of our decision.
- If found free of fault (non-faulty return), we will notify you of the restocking fee and return shipping cost (if applicable). Payment must be received within 14 days; if not, Goods will be held for a maximum of 30 days and then disposed of.
- If Goods are incomplete, damaged on arrival, or not in resaleable condition, we reserve the right to return them to you at your expense.

6.5 Data backup: You are responsible for backing up any data stored on hard drives, SSDs, or other storage devices before returning them. We are not liable for data loss.

## 7. NO OTHER WARRANTIES

7.1 Manufacturer warranties: Some Goods come with manufacturer warranties in addition to our 12-month warranty. Manufacturer warranties are separate and subject to the manufacturer's terms, check your product documentation.

7.2 No other representations: Except as stated above, we make no warranty regarding:
- Fitness for a particular purpose
- Compatibility with your system (you are responsible for checking compatibility before purchase)
- Quality or performance beyond the manufacturer's specifications

7.3 Custom PC builds: If you purchase a custom-built PC from us:
- The build includes a 12-month hardware warranty only
- We do not provide software support, driver installation support, or first-line technical troubleshooting
- The build cannot be cancelled or modified once assembly has begun
- You accept the risk that custom builds may have component compatibility issues that emerge during use; these are the customer's responsibility to address via the component manufacturers' support

## 8. LIMITATION OF LIABILITY

8.1 We are not liable for:
- Loss of profits, revenue, data, or business interruption
- Any consequential, indirect, or special damages
- Damage to your other equipment or systems resulting from the Goods
- Delays in delivery caused by our courier, weather, strikes, or circumstances beyond our control

8.2 Our total liability is limited to the amount you paid for the faulty Goods, and only for direct, foreseeable losses.

8.3 Nothing in these terms excludes or limits our liability for death, personal injury, fraud, or breaches of UK consumer law, which cannot be limited.

## 9. YOUR RESPONSIBILITIES

9.1 Compatibility: You are responsible for ensuring Goods are compatible with your system. We recommend checking specifications before purchase.

9.2 Handling: You must use appropriate anti-static precautions when handling electronic components. Damage from improper handling voids the warranty.

9.3 Storage and use: Store and use Goods according to the manufacturer's instructions. Improper storage (heat, moisture, physical damage) voids the warranty.

## 10. PAYMENT AND TITLE

10.1 You own the Goods once payment is received in full.

10.2 Until payment is received, we retain the right to recover the Goods, though this does not affect your right to return them under the warranty or returns policy.

## 11. INTELLECTUAL PROPERTY

11.1 All G-TEK branding, logos, website content, and product descriptions are our intellectual property. You may not use our trademarks or content without permission.

11.2 The Goods themselves may carry manufacturer trademarks, which remain the property of the manufacturer.

## 12. DATA PROTECTION

12.1 We collect personal data (name, address, email, phone) to process your order and provide customer service.

12.2 Your data is processed in accordance with the UK GDPR and Data Protection Act 2018. See our Privacy Policy for full details.

12.3 We will never sell your data to third parties without consent.

## 13. WEBSITE AND SERVICES

13.1 We reserve the right to withdraw or update our website and services at any time.

13.2 We are not liable if our website is temporarily unavailable due to maintenance, technical issues, or circumstances beyond our control.

13.3 Our website may contain links to external sites. We are not responsible for the content or accuracy of those sites.

## 14. FORCE MAJEURE

14.1 We are not liable for delays or failure to deliver if caused by circumstances beyond our control (war, pandemic, natural disaster, strikes, supply chain disruption, etc.).

14.2 If such circumstances prevent delivery for more than 30 days, we may cancel your order and issue a full refund.

## 15. GOVERNING LAW

15.1 These terms are governed by English law and the courts of England and Wales.

15.2 Consumer protection: If you are a consumer (buying for personal use, not business), you have rights under UK Consumer Rights Act 2015, which cannot be removed by these terms. These terms do not limit those statutory rights.
